Privacy Policy
Introduction
Deako, Inc. ("Deako," "we," "us," or "our") operates hipowerhomeservices.com (the "Site") and the residential electrical services program offered through it (together with the Site, the "Program"). The electrical work sold through the Program is performed by Hi Power Electric LLC, a licensed Colorado electrical contractor ("Hi Power"). This Privacy Policy ("Policy") describes how we collect, use, store, process, and share your information in relation to the Program, and what we share with Hi Power so the work can be performed.
This Policy applies to information collected from you when you use the Program. By using the Program, you expressly consent to the collection, use, storage, transfer, processing, and disclosure of your information as described in this Policy. If you do not agree with this Policy, do not use the Program. This Policy is part of and incorporated into the Program's Terms of Service ("Terms"). Capitalized terms not defined in this Policy have the definitions set forth in the Terms.
1. Who collects your information
Deako is the seller of the Services and the operator of the Site, and is responsible for the information collected through the Program. Deako shares job information with Hi Power so Hi Power can schedule, perform, permit, and warranty the electrical work, as described in Section 6. Program information is kept separate from the customer records of Deako's own product business, and moves there only as described in Section 8.
2. Age requirement
The Program is not for or directed towards children, and you must be at least eighteen years of age to purchase Services. We will never knowingly collect information from children under the age of thirteen; if we learn that we have, we will delete the information immediately. If you believe information from a child has been provided to the Program, please notify us at privacy@deako.com.
3. Information we collect
We collect information you provide and information collected automatically as you use the Program. Information you provide may include:
- Contact and property information: your name, email address, telephone number, and the service address, provided through forms, the quote widget, calls, or texts;
- Job information: the service you request, your answers to scoping questions, scheduling preferences, access notes, and details of transactions and fulfillment of your orders;
- Photos and video of areas of your home that you submit for quoting purposes;
- Recordings and transcripts of calls and text conversations with our sales and service team, where permitted by law and disclosed at the time;
- Your responses to surveys, reviews you submit, and any communications you voluntarily send us in any format.
Payment card information is collected and processed by our third-party payment processor, not by Deako, as described in Section 7.
4. Information we collect automatically
As you navigate the Site, we may use automatic data collection technologies to collect information about your equipment, browsing actions, and patterns, including traffic data, usage statistics, IP address, device and browser type, referring pages, and general location, and information about how you arrived at the Site (such as the ad or search that brought you). We may use analytics providers such as Google Analytics to collect this information; it does not identify you, and we use it to understand and improve the Program, operate our business, and measure advertising.
The technologies we use include cookies (small text files stored on your device for record-keeping purposes; you may set your browser to reject cookies and may still use the Site) and pixels (tiny graphics with a unique identifier embedded on web pages or in emails, used by our analytics and advertising providers to measure activity). We do not control the use of cookies or pixels by third parties. If you would like to opt out of Google Analytics tracking, you can use the Google Analytics Opt-out Browser Add-on. Because we track usage through cookies, pixels, and similar mechanisms, the Site does not support "Do Not Track" requests.
5. How we use your information
We collect your information to:
- Provide quotes, schedule, and manage the Services you request, and share the job with Hi Power to perform it;
- Communicate with you about your request, booking, and job by phone, text message, or email, in accordance with the consent language presented where you submitted your information;
- Operate, manage, and administer the Program; fulfill orders; process payments through our processor; and provide support;
- Monitor and improve the Program, train our team (including through call recordings), and develop and test improvements;
- Ask for your feedback and reviews after a job;
- Resolve disputes; detect and protect against errors, fraud, and illegal activity; assist law enforcement; and enforce this Policy and the Terms;
- For any other purpose described in this Policy or described to you at the time of collection.
6. What we share with Hi Power
We share with Hi Power the information needed to perform your job: your name, service address, contact information, the scope and price of the work, scheduling details, access notes, and quoting photos or video relevant to the work. Hi Power uses this information to schedule, perform, permit, inspect, and warranty the electrical work and for its related legal and insurance obligations, and not for its own marketing outside the Program.
7. Other disclosure of your information
We may disclose your information to affiliated entities, business partners, agents, and service providers that help us operate the Program, such as customer service, scheduling, analytics, advertising measurement, and communications providers. We will not share your personal data for marketing purposes or with other third parties for purposes unrelated to the Program without your explicit consent. We do not "sell" or "share" your personal information as those terms are defined under applicable state privacy laws.
We may also disclose your information as required by applicable law or legal regulation; if we believe disclosure is needed to protect our rights, property, or safety; to government regulators or law enforcement authorities in connection with any judicial proceeding, court order, subpoena, or legal process served on us; or to respond to a physical threat to you or another person. If Deako engages in a business transition such as a merger, acquisition, or sale of assets, or files for bankruptcy, your information may be disclosed to prospective or actual purchasers in connection with that transaction.
Credit card payments are handled through our third-party payment processor, which will collect and may retain your payment information in order to process your payment. We do not control the processor's collection, use, disclosure, or retention of your information; you can review its privacy policy at checkout.
8. Deako products and product registration
If Deako products are installed as part of your job and you choose to register them, create a Deako account, or use the Deako app, the information you provide directly to Deako for that product relationship is governed by Deako's general Privacy Policy at deako.com/privacy, not this Policy. Registering installed products is optional and is how you activate manufacturer warranty and product features.
9. Information retention
We strive to retain your personal data for no longer than is reasonably necessary for its processing purpose. The applicable retention period depends on the purpose for which the data was obtained and on data retention obligations arising from applicable laws. We may retain personal data for a longer period where required by law, and job records may be retained for warranty, permit, tax, and dispute purposes.
10. Data security
Keeping your information secure is of great concern to us. We exercise care in facilitating the transmission of information between your device and the third-party servers that operate and store information for the Program, and the personal data we collect is stored in operating environments that are not available to the public. However, no transmission of data over the Internet or any other public network can be guaranteed to be secure, and any transmission of personal data is at your own risk.
11. Your data privacy rights
Regardless of the state you live in, we extend to you the following rights over the personal information we hold about you:
- Confirm whether we are processing your personal information;
- Correct inaccuracies in the personal information being processed;
- Request deletion of your personal information (subject to applicable exceptions, including records we must keep for warranty, permit, tax, or legal purposes);
- Obtain a copy of the data you provided to us in a digital format;
- Opt out of the processing of personal information for targeted advertising, of any sale of personal information, or of profiling that produces significant effects on you.
To exercise your rights, submit a request by emailing privacy@deako.com. We may ask for your name, email address, and booking information to verify your identity or your authorized representative's identity. We endeavor to substantively respond to a verifiable consumer request within forty-five days of its receipt, unless we require an extension, in which case we will inform you of the reason and extension period. We will not discriminate against you for exercising any of your data rights, and we do not charge a fee to process a verifiable request unless it is excessive, repetitive, or manifestly unfounded. California residents may also request information regarding disclosure to third parties for direct marketing purposes under California Civil Code Section 1798.83 by contacting us at the address below.
12. Notice of financial incentive
We may offer programs and benefits related to the collection, retention, and use of personal information that may be deemed a financial incentive under applicable law, such as a discount in exchange for an email address. The amount and terms of such offers will be presented to you at the time of the offer, and you can terminate participation at any time by contacting us or submitting a data request as described in Section 11.
13. Changes to this Policy
We reserve the right to make changes to this Policy at any time by notifying you on hipowerhomeservices.com/privacy. Check this page often, referring to the "Last Updated" date listed above.
14. Privacy questions
If you have questions, concerns, or suggestions regarding this Policy, please contact us at privacy@deako.com.
