Terms of Service
The short version
For convenience; the numbered sections are the agreement.
Your contract for electrical work is with Hi Power, a licensed and insured Colorado electrical contractor. Hi Power sets every price, gets every payment, does the work, pulls the permits, and warranties the workmanship for at least 12 months. Deako runs the website, the sales desk, scheduling, and checkout for Hi Power. Deako is not an electrical contractor and never holds your money. A $125 deposit books your job and counts toward the total; cancel at least 24 hours ahead and you get it back. If the crew finds something that changes the scope, work stops until you approve the new price, or you can cancel and get a refund for work not done. Disputes go to individual arbitration, and you can opt out of arbitration within 30 days (Section 19).
The parties
- Hi Power — Hi Power Electric LLC, a licensed and insured Colorado electrical contractor. Sells and performs the Services. Your service contract is with Hi Power.
- Deako — Deako, Inc., a Delaware corporation. Owns and operates the Site and administers the Program as Hi Power's disclosed agent. Your agreement for use of the Site is with Deako.
- Customer — You. The person who visits the Site, requests a quote, or purchases Services.
Accepting these Terms forms two agreements at once. The Service Terms (Sections 4 through 10) are a contract between Customer and Hi Power for the Services. The Platform Terms (Sections 11 through 14) are a contract between Customer and Deako for use of the Site and Program platform. Sections 1 through 3 and 15 through 21 apply to both. The Privacy Policy is incorporated into these Terms. "Site" means hipowerhomeservices.com. "Services" means the residential electrical services offered through the Site and the Program sales team. "Program" means both together.
Customer accepts these Terms by checking the acceptance box at checkout, or by confirming a booking with the sales team after these Terms are disclosed. Using the Site to request a quote also accepts the Platform Terms.
These Terms contain a mandatory arbitration provision and class action waiver, with a 30-day right to opt out. See Section 19.
1. Who does what
Customer's purchase of Services is a contract with Hi Power. Hi Power is the seller and merchant of record. It sets and confirms every price, receives every payment, supplies and supervises the licensed electricians who work in Customer's home, obtains required permits, performs the work to applicable codes, collects and remits sales tax, and provides the workmanship warranty in Section 9. Hi Power is responsible for the manner, means, and safety of the electrical work, and carries general liability insurance and workers' compensation coverage.
Deako operates the Program for Hi Power as its disclosed agent: advertising, presenting Hi Power's prices, scheduling, customer service, and administering the checkout. Deako is not an electrical contractor. It performs no electrical work, supervises no crews, is not a party to Customer's contract for the Services, and never receives or holds Customer's payments. Every payment goes to Hi Power. Nothing in these Terms limits Hi Power's responsibility for the electrical work or Customer's rights under applicable law with respect to that work.
2. Age and authority
Customer must be at least eighteen years old to purchase Services, and represents that Customer owns the property where Services will be performed or is authorized by the owner to order the work.
3. Changes to these Terms
Deako maintains these Terms as program administrator and may post revisions. No revision takes effect until Hi Power has adopted it. Changes apply to use of the Site and to Services ordered after posting. Changes to Section 19 do not apply to disputes the parties have actual notice of before the change is posted. Continued use of the Site or Program after revised Terms are posted constitutes acceptance.
4. Quotes and pricing
Prices shown on the Site are typical prices for common jobs. Every job is priced individually, and every price is confirmed by Hi Power before it is final. Quotes are prepared from the information Customer provides (scoping answers and photos or video of the home) and presented by Deako on Hi Power's behalf. Hi Power reviews and confirms or updates each quote.
If a quoted price changes before work begins, the updated amount is presented to Customer, who may approve it or cancel for a full refund, including the deposit. A quote covers the scope described in it. Diagnostics, troubleshooting, and added on-site time are billed at the hourly rate disclosed before booking. A diagnostic charge may include an initial period of on-site time and, where stated at booking, applies toward a resulting repair. Some services require a free on-site assessment before a final price can be confirmed. If conditions at the property differ from the information provided, Section 6 applies.
5. Booking, deposit, cancellation, and refunds
Unless different terms are shown at booking:
- Hi Power charges a $125 deposit at booking through the Deako-administered checkout. The deposit is credited toward the job total; it is not an extra fee. The balance is collected at completion.
- Cancel or reschedule at least 24 hours before the scheduled arrival window and the deposit is refunded in full.
- Cancel inside that window, or fail to give the crew safe access at the scheduled time, and Hi Power may keep the deposit as a cancellation fee.
- Refunds go to the original payment method within 10 business days.
Statutory right to cancel. Where the sale is made at Customer's home, cancellation rights under applicable law (including the federal three-day Cooling-Off Rule) apply and control over this section. The required notice of cancellation is provided at the time of sale.
Customer agrees to provide safe and reasonable access to the work area at the scheduled time, including securing pets. Neither Hi Power nor Deako is responsible for delays caused by events beyond reasonable control, such as weather, supplier shortages, utility work, or permit and inspection delays. If one occurs, the appointment is rescheduled promptly.
6. Changes in scope and conditions at the property
If the crew finds conditions that change the scope or price, work on the change pauses until the change and its price are reviewed with Customer and approved. Customer may decline the change and cancel the remaining work for a refund of amounts paid for work not performed. Declining a scope change is not a late cancellation; the deposit is refunded, less amounts for work already performed and accepted. Approved changes are billed through the standard checkout. The crew does not collect payment on site.
Pre-existing conditions. Hi Power is not responsible for conditions that existed before the work began, including prior code violations, unpermitted work, or latent defects in wiring or equipment outside the quoted scope. If such a condition is discovered, or a permitting authority requires corrections beyond the quoted scope, it is handled as a scope change under this section.
Access openings. Reaching wiring sometimes means cutting openings in drywall or other finishes. The crew makes openings no larger than reasonably necessary. Repairing, patching, and repainting access openings is not included unless the quote says so.
7. Payments and financing
All payments for Services are made to Hi Power as seller and merchant of record, at the times shown at checkout. Deako administers the checkout as Hi Power's agent and never receives or holds Customer's funds. Payments are processed by a third party payment processor; neither Hi Power nor Deako accesses or stores full card information. Installment financing, where offered, is provided at checkout on Hi Power's merchant account, subject to the financing provider's terms and eligibility. Financing does not change the price. Sales and use taxes are added to the prices shown and are collected and remitted by Hi Power. Customer pays on Customer's own device; no member of the crew or sales team handles Customer's card.
Amounts not paid when due may accrue interest at 1.5% per month, or the maximum rate permitted by law, whichever is less, plus reasonable collection costs. Colorado law gives contractors and suppliers lien rights with respect to property they improve. Nothing in these Terms waives any right or remedy available to Hi Power under applicable law.
8. Permits and inspections
Where the work requires a permit, Hi Power applies for and obtains it under its license and schedules required inspections. Customer agrees to provide reasonable access for inspections. Permit and inspection timelines are set by the local authority and communicated at or after booking.
9. Warranties on the work
Hi Power provides a workmanship warranty of at least twelve months on its electrical work. The exact term and conditions are stated on the invoice or provided at booking, and warranty service is performed by Hi Power. Products installed as part of the Services carry their manufacturers' warranties, including Deako products under the Deako Limited Warranty. Some products require registration to activate warranty or product features.
The workmanship warranty does not cover misuse, abuse, or neglect; modifications or repairs made by anyone other than Hi Power; customer-supplied products; pre-existing conditions described in Section 6; or ordinary wear.
Customer-supplied products. Where Customer supplies a product for installation (an EV charger or a ceiling fan, for example), Hi Power installs it but does not warrant the product itself. Defects in, damage caused by, or delays resulting from a customer-supplied product are not Hi Power's responsibility. The workmanship warranty covers the installation work only.
To make a claim, contact the Program (Section 21) and the claim is routed to Hi Power. If Hi Power does not begin correcting a covered defect within ten business days after written notice, or immediately for a safety hazard, Deako may arrange for the covered correction to be performed by another licensed electrical contractor. That correction is limited to what Hi Power's workmanship warranty covers. Work outside that scope is quoted to Customer and proceeds only with Customer's approval.
10. Customer responsibilities and conduct
Customer is responsible for the accuracy of the information, photos, and video provided for quoting; for disclosing known conditions affecting the work (such as prior unpermitted work, aluminum wiring, or known panel issues); and for decisions about the property. If inaccurate information materially changes the job, Section 6 applies.
Hi Power may decline to begin or continue work, and Deako may suspend Program access, where a Customer or anyone at the property is abusive, threatening, or unsafe toward the crew or Program staff. Amounts for work already performed and accepted remain due; the deposit is otherwise refunded.
11. Communications
When Customer submits a form, calls, or texts the Program, Deako communicates with Customer about the request on Hi Power's behalf, as described in the consent language presented at the point of submission and in the Privacy Policy. Calls with the sales and service team may be recorded for quality assurance; a disclosure plays when recording applies. Reply STOP to opt out of texts. Use the unsubscribe link to opt out of marketing email.
12. Reviews, content, and feedback Customer submits
By submitting reviews, comments, photos, or testimonials to the Program, Customer grants Deako and Hi Power a worldwide, royalty-free, perpetual, sublicensable, transferable, non-exclusive license to use, reproduce, modify, adapt, publish, display, and distribute that content in connection with the Program, and to publish Customer's first name and general location with it. Customer represents that Customer holds the rights needed to grant this license. Deako may remove or decline to publish content in its sole discretion. Suggestions and feedback Customer provides about the Program may be used by Deako and Hi Power without restriction or obligation to Customer.
13. Permitted use of the Site and copyright complaints
The Site and its content are owned and operated by Deako and its licensors. This section is an agreement between Customer and Deako. Customer may use the Site only for lawful purposes connected to requesting and managing Services, and may not scrape, copy, republish, disassemble, or reverse engineer any portion of the Site; interfere with its operation; impersonate any person; or use the Site to transmit unlawful or infringing content. Unauthorized use may result in termination of access and legal action.
Notices of claimed copyright infringement concerning content on the Site may be sent to Deako's designated agent at [copyright agent email, name and address]. Deako will respond in accordance with the Digital Millennium Copyright Act.
14. Trademarks
Deako and its logos are trademarks of Deako, Inc. Hi Power Electric and its logos are trademarks of Hi Power Electric LLC. Each is used in the Program with its owner's permission. These Terms grant no license to use any trademark.
15. Disclaimer of warranties
Except for the express workmanship warranty and manufacturer product warranties described in Section 9, and to the maximum extent permitted by applicable law, the Site, the Program, and the Services are provided "AS IS" and "AS AVAILABLE." Hi Power and Deako, and their respective suppliers, affiliates, and licensors, each disclaim all other representations, warranties, and conditions, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Deako does not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that information obtained through it will be accurate, complete, or reliable.
16. Disclaimer of certain damages
To the maximum extent permitted by applicable law, neither Hi Power nor Deako, nor their respective affiliates, suppliers, or licensors, is liable for consequential, special, incidental, indirect, or punitive damages; loss of profits, business, goodwill, anticipated savings, or use; loss or corruption of data; or business interruption, arising out of or related to these Terms, the Site, or the Services, even if advised of the possibility of such damages. This section does not limit Hi Power's liability arising from the electrical work it performs.
17. Limitation of liability and exclusive remedy
To the maximum extent permitted by applicable law, and to the extent not excluded under Sections 15 or 16, the maximum aggregate liability of Deako and its affiliates, suppliers, and licensors to Customer for all claims arising out of or related to these Terms, the Site, or the Program is Customer's actual damages up to the amount Customer paid for the Service giving rise to the claim. The same limit applies to claims against Hi Power other than claims arising from the electrical work. Nothing in this section limits Hi Power's responsibility for the electrical work it performs. These limitations do not apply to liability resulting from a party's gross negligence or willful misconduct, or to death or bodily injury caused by that party's own acts or omissions. Multiple claims do not enlarge these limits.
18. Indemnification
Customer agrees to defend, indemnify, and hold Hi Power and Deako, and their respective directors, officers, employees, agents, partners, suppliers, affiliates, and licensors, harmless from any third party claim or demand, including reasonable attorneys' fees, arising from (a) content Customer submits, (b) Customer's violation of these Terms, or (c) Customer's violation of another party's rights or applicable law.
19. Governing law, arbitration, and class action waiver
A. Governing law. These Terms are governed by the laws of the state where the Services are performed (for this Program, Colorado), without reference to conflict of laws rules. Nothing in these Terms displaces consumer protections Customer is entitled to under applicable law.
B. Talk first. Customer, Hi Power, and Deako agree to try in good faith to resolve any dispute by informal negotiation for 15 business days after notice of the dispute.
C. Pre-arbitration notice. Before initiating arbitration, the claiming party must send a signed written notice describing the claim and the relief sought, including the claimant's name, address, and email. Notices go to Deako at 4201 Roosevelt Way NE, Suite 100, Seattle, WA 98105, or to Hi Power at [Hi Power notice address]. The parties then negotiate in good faith for sixty days. Limitations periods are tolled during that time.
D. Arbitration. All claims against Hi Power or Deako will be resolved by binding individual arbitration rather than in court, except claims properly brought in small claims court. There is no judge or jury in arbitration, and court review of an award is limited. Arbitration is governed by the Federal Arbitration Act and administered by the American Arbitration Association under its then-applicable rules, including the Consumer Arbitration Rules and Mass Arbitration Supplementary Rules. Where this provision conflicts with those rules, this provision governs. There is one neutral arbitrator, the proceeding is in English, and any in-person hearing takes place in the county where the Services were performed or another location the parties agree on. If the arbitrator finds that the costs of an arbitration Customer initiates would be prohibitive compared to litigation, the responding party will pay the arbitration costs necessary to prevent that. If the arbitrator finds the claim frivolous or brought for an improper purpose, Customer reimburses those costs and fees. The award is final and binding, and judgment may be entered in any court of competent jurisdiction.
E. Class action waiver. All claims will be resolved only on an individual basis, not in a class, consolidated, or representative action or arbitration. If a claim proceeds in court rather than arbitration, each party waives trial by jury, and the claim will be brought only in the state or federal courts located in the county and state where the Services were performed.
F. Equitable relief. Deako and Hi Power may each seek injunctive and other equitable relief from any court of competent jurisdiction to protect intellectual property rights.
G. Right to opt out. Customer may opt out of arbitration and the class action waiver (Sections 19.D and 19.E) by sending written notice to either address in Section 19.C within 30 days after first purchasing Services. The notice should state Customer's name, address, and intent to opt out. Opting out does not affect any other section of these Terms.
20. General
If any provision is held illegal, invalid, or unenforceable, the remaining provisions stand. Hi Power and Deako may each assign their respective agreements in connection with a merger, acquisition, or sale of assets, and Deako may assign to an affiliate. Customer may not assign. These Terms, with the Privacy Policy and the order and cancellation terms presented at booking, are the entire agreement between Customer and Hi Power, and between Customer and Deako, regarding the Program. No one else has any right to enforce them. Sections 9 (warranties), 12 (content license), 15 through 18 (disclaimers, limitations, and indemnification), 19 (dispute resolution), and 20 survive completion of the Services and any termination of Site access.
